Abstract
Internet has become one of the most influential factors in modern life, this phenomena brings along a great amount of new challenges for the law. It is specially challenging for the defense and protection of the most fundamental human liberties of the global citizen. It is important then, to analyze, based on the vast influence and importance of digitalization and the Internet, which is the current scope of the protection of digital rights in the framework of International Law. Drafting a diagnosis of the current situation using the categories within Article 38 of the International Justice Court. This article finds voids, silences and a precarious legal situation for the citizen-user of the web and highlights the necessity of a legal Framework for Digital Human Rights within International Law.
