Abstract
The exercise of the criminal policy is usually understood from a regulation perspective; however, it is possible to identify a descriptive use of the concept and assume it as an exercise of power in relation to the criminal phenomenon in which discourses and punitive practices interact. In this article it will be referred the relationship among discourses (knowledge) and punitive practices (power) involved in the formation of a criminal policy as the designed with the defense policy and “democratic security”.
