Trasplantando Dudas. Una Ponencia.*

Abstract

The transplant of legal institutions that will be discussed in the future, is manifested in the various areas of law, however, given space limitations, only a study on the accusatory US criminal procedure system, and especially the test standard, will be carried out. in him conceived of "beyond reasonable doubt".
It should be clarified that the need is shared that in the legal systems are transplanted figures outside their own elaborations, however, the mechanisms of selection of these phenomena seem to obey to logics of globalization that are framed within one of the requirements of order global economic and uniformity of procedural systems around the world.
In this sense, the text will be developed in the following way: First, it will reflect on the legal culture, the description of legal transplants, the impact of globalization on these, as well as legal and criminal reforms in Latin America ; Finally, reference will be made to the test standard "beyond reasonable doubt", and some problems that revolve around it.
